DetourGuy‘s Terms of Service

DetourGuy, including but not limited to its websites, mobile applications, social media platforms, reward schemes, travel services, partners programs, and any other content, is provided on “as is” basis. DetourGuy Limited (“company”, “we”, or “us”) assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any content, communications or personalized settings.

Your use of DetourGuy means you agree to these Terms of Service (“terms”), and is at your sole risk.

Use of DetourGuy

By using DetourGuy, you understand that any content, including but not limited to text, photographs, graphics, videos or other information, whether publicly posted or privately transmitted, is the sole responsibility of the person who makes it available. This means that you, not DetourGuy Limtied, are entirely responsible for all content that you upload, post, email, transmit or otherwise make available via DetourGuy. We do not and cannot control all the content posted via DetourGuy and, as such, do not guarantee the accuracy, integrity or quality of such content.

Prohibited Activities

You agree to not use DetourGuy to –

1. Upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of privacy, hateful, or racially, ethnically or otherwise objectionable.

2. Harm minors in any way.

3. Upload, post, email, transmit or otherwise make available any content that you do not have the right to do so under any law, contracts, non-disclosure agreements, or fiduciary relationships (such as insider, proprietary and confidential information).

4. Upload, post, email, transmit or otherwise make available any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.

5. Upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer codes, files or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware, or telecommunications equipment.

6. Interfere with or disrupt DetourGuy, including its content, software, servers and networks, or disobey any requirements, procedures, policies or regulations of networks connected to DetourGuy.

7. Intentionally or unintentionally violate any applicable law, including, without limitation, any regulations having the force of law.

User Generated Content

You acknowledge that DetourGuy’s content may or may not be pre-screened, but that DetourGuy Limited and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or remove any content that is available via DetourGuy. Without limiting the foregoing, DetourGuy Limited and its designees shall have the right to remove any content that violates these Terms of Service or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

Third-Party Information

DetourGuy may contain information provided by third parties or sourced by us from various business and information sources. DetourGuy Limited is not responsible if any such information is not up-to-date. We do not separately verify the information provided by such third party or agency, and thus you are cautioned to the reliability and accuracy of such information. We do not accept any responsibility whatsoever in respect of any such information. Any use of and reliance on such information is at your own risk.

Links on DetourGuy may take you to third-party sources, including but not limited to other websites, mobile applications, and advertisements. You acknowledge and agree that DetourGuy Limited has no responsibility for the accuracy or availability of any information provided by these linked third-party sources. Links to third-party sources do not constitute an endorsement or recommendation by us of those sources, or of the information, products, advertising, or other materials available on those sources.

Intellectual Property

All intellectual property rights subsisting in respect of DetourGuy belong to DetourGuy Limited or have been lawfully licensed to or permitted for DetourGuy Limited for use on DetourGuy. Any content downloaded by you including the text and images incorporated in or generated by DetourGuy is for your personal and non-commercial use only.

Liability Disclaimer

DetourGuy Limited is not responsible for incorrect or inaccurate transcription of information, for problem related to any of the equipment or programming associated with DetourGuy or utilized by you, for any human or technical error of any kind, for any interruption, deletion, omission, defect, or line failure of any telecommunication network or electronic transmission, for problems relating to computer equipment, software, inability to access DetourGuy or third-party sources, or for any other technical or non-technical error or malfunction.

Service and Payment

For pricing and payment terms of certain fee-based DetourGuy services and products, please refer to the latest information provided online and offline. This information may be amended and updated at our sole discretion from time to time without prior notice. By using or purchasing these services or products, you agree to make payment(s) according to the payment terms.

Indemnification

You agree that you shall defend, indemnify and hold DetourGuy, DetourGuy Limited, our staff, users, and partners harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including lawyer and legal fees) arising out of or in connection with your violation of any of these Terms of Service or any applicable law or regulation, your violation of any rights of any third party, including our users and partners, or your use or misuse of DetourGuy or our services or products.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Hong Kong. Both you and us agree to submit to the exclusive jurisdiction of the courts of Hong Kong in case of disputes arising under these terms.

Changes to these Terms of Service

DetourGuy Limited may change, add to or delete any terms from these Terms of Service from time to time and, where required by law, will notify you by email if you have provided us one. By continuing to use DetourGuy following such modifications to the Terms of Service, you agree to be bound by such modifications.

Miscellaneous

In case of discrepancy between the English and Chinese versions of this Terms of Service, the English version shall prevail.
